July 2005 - HEEZE-LEENDE - oud-burgemeester Planje van Heeze-Leende
lodge an appeal in appeal against of short geding-rechter in Utrecht.
M. Ambags, lawyer of Planje, expect that they this so-called
emergency appeal will win Ambags at the Court of Justice in Amsterdam:
"the utrechtse judge has undeserved a number of important
matter not weighted." According to Ambags short geding-rechter
has put undeserved that there is no causal connection between
Bmc-rapport and the motion of mistrust which the college got previous
year July to its trousers. Ambags: "the judge has only
looked at to the recommendations of the report, but she look at would
have had also to the conclusions in which undeserved it is put that
the college already financial obligations had contracted."
According to Ambags the Council has been scared of those
conclusions concerning the finances and has them for this reason
decided give a motion of mistrust to the college. Also the judge
has too a little looked at to the quality of the report, thus the
lawyer of the oud-burgemeester finds. The judge stated in its
sentence which it is ' not incomprehensible ' that office BMC has been
at loving interview selective because the research had within two
weeks finished. Ambags find that argumentation ' too crazy for
words '. It does not concern quality, for the speed.
Certainly an office that says act according to ISO-9001 and
Roa-normen must deliver a quality product. Hearing the ' key
characters ' is not according to the lawyer a capital misser. "it is unqualifiable, carelessly and with that to judge unlawfully
concerning people without hearing those people themselves."
Explanation in the emergency appeal must Planje and office gives
an explanation again to BMC on the matter. Ambags expect that
this appeal by the end of serves august. The pronouncement is
there then in September. Planje dragged office BMC for the judge
in Utrecht because the office has provided according to its
broddelwerk. That report had clear Planje the field. She

and that the report would be adapted. The oud-burgemeester wants
an adapted report with that material and immaterial damage which they
