Possibly nevertheless insured for AOW after migration
Spent: 24 February 2005 11.43 LUXEMBOURG - the Dutch
government stevent finished on a precious judgment of the European
judge. Solicitor General Jacobs has recommended the European
Court of Justice that emigrated Dutch's must right on compulsory
insurance for AOW (old age), Anw insurance (surviving dependants) and
AKW (child benefit). The prominent lawyer does not find it
compatible with the European law that a person who no longer lives in
the Netherlands obliges no longer insured is for some parts of the
social security. The Court of Justice must pronounce sentence
soon concerning the matter. A Dutch salary-earner who had moved
to Belgium, had tightened the matter. By an amendment to the law
by 1 January 2000 the woman lost its compulsory insurance, and with
its 30,000 others. The Dutch Sociale Verzekeringsbank offers,
however, a voluntary insurance to geƫmigreerden. But the
Solicitor General finds that not sufficient. According to him
people can be also with the voluntary insurance insufficiently
protected, what is contrary with the European law. He refers for
that to figures of the Dutch government: of the 30,000 persons
who have been met by the amendment to the law, there have taken only
8000 a voluntary insurance. He who it is not insured for for
example AOW, a lower benefit gets after its 65th anniversary.
The benefit decreases 2 per cent for each year that a Dutchman
